| 本文首先归纳出黄河立法必须了解的黄河治理与保护中仍面临的突出问题和困难,基于此,对《中华人民共和国黄河保护法(草案)》不完善之处进行了分析探讨,并针对有关法条阐释立法建议。例如,黄河流域生态保护和修复的基础在于通过科学规划与合理管控,以期推动黄河流域实现可持续发展;黄河生态保护对应的发展模式是绿色发展,而黄河绿色发展未必能够实现高质量发展,对于复杂难治的特殊河流,只有加强治理才能更好保护,进而实现高质量发展;对于技术支撑能力欠缺而难以作为执法依据的内容,为维持执法的权威性,条款的措辞上应留有余地;黄河立法工作应重视治理体制改革,一旦政策制订、工程审批、执法的部门相对超脱,且不再直接参与相关的企业行为,即可引入巨大的社会力量,明显提高黄河治理效率;站在保证滩区人民群众安全的高度,将滩区内居民全部外迁既不现实也不必要。 |

| The existing issues and difficulties that legislation must be aware of in the governance and preservation of the Yellow River are summarized. Based on this, the imperfections in the " the law of the People's Republic of China on the Protection of Yellow River (Draft) " are analyzed and explored, and the legislative suggestions is explained according to the relevant provisions. For instance, the foundation of ecological protection and restoration in the Yellow River Basin is to promote the sustainable development of the Yellow River Basin through scientific planning and prudent management. To achieve high-quality development, it is vital to insist on both governance and preservation for the Yellow River, a unique river that is complicated and difficult to govern. In order to maintain the authority of law enforcement, there should be room for the wording of articles that need to improve the technical level and are difficult to use as the basis for law enforcement. Legislation should pay attention to the reform of governance system. Once the departments responsible for policy formulation, project approval and law enforcement are relatively detached and no longer directly participate in relevant enterprise behaviors, the social influence can significantly improve the governance efficiency of the Yellow River. From the perspective of ensuring the safety of the people in the floodplain, it is neither realistic nor necessary to relocate all the residents in the floodplain area. |
