| 从法学视角对水资源概念进行合理、准确的界定，对于进一步明确国家水资源所有权的范围、性质及内容，科学核算水资源资产价值，深入开展水权问题研究，促进水资源的管理、保护及合理的市场化配置有着重要意义。本文对现有的水资源概念表述进行了形式逻辑和实质意义分析;结合分析成果，以自然科学和社会科学交叉融合的理论视角，将关注焦点从水物质实体转向功能与服务;通过对水文循环过程及其功能、水文循环与社会经济系统关系，以及“自然资源”这一水资源上位概念的分析，认为水资源的本质是天然水文循环提供给社会经济系统的服务。在充分考虑法律概念可操作性的基础上，将水文循环为社会经济系统提供的除水物质本身以外的服务也统一纳入水资源概念范畴，进而给出了水资源概念的法学表述，实现了对水资源概念更高程度的理论概括。 |

| To define the concept of water resources accurately and reasonably from a legal perspective，it is necessary for further clarifying the scope of state ownership of water resources，scientifically calculating the value of water resource assets，deeply researching water rights and promoting the management，protection and reasonable market allocation of water resources.In this paper，the existing explanation of the concept of water resource was analyzed from the aspects of formal logical and real significance combined with the analysis results and the theoretical perspective of cross integration of natural science and social science，this paper transfers the focus of attention from the water substance to the function and service.Through the analysis of hydrological cycle and its function，the relationship between hydrological cycle and social economic system as well as an analysis of “natural resources" which is a superordinate concept of “water resource”，this paper reveals that the essence of “water resources” lies in the service provided by the natural hydrological cycle provide to social and economic systems.By fully considering the operability of legal concepts，the services provided by the hydrological cycle for the socio-economic system，apart from the water substance itself，are integrated into the concept of water resources.Subsequently，a legal expression is given to define the concept of water resource，thereby achieving a higher level of the theoretical generalization of the concept connotation and denotation of water resources. |
